They also govern orders placed with Sylvie Silk unless different terms are expressly stated in writing for a particular product, service, promotion, or transaction.

Sylvie Silk makes reasonable efforts to present products accurately.
The appearance of color, sheen, transparency, texture, scale, and surface detail may vary according to:
- screen calibration;

- production batch;
- dye lot;
- fabric direction; and
- the natural reflective qualities of silk.
Silk may display slubs, irregularities, color movement, weave variation, or other characteristics associated with the fabric or method of production. Such characteristics are not necessarily defects.
Hand-finished or individually made merchandise may contain slight variations in:
- dimensions;
- placement;
- gathering;
- stitching;
- pattern alignment;
- drape; or
- decorative arrangement.
Material differences that affect the product’s conformity will be evaluated under applicable law and the relevant return policy.
Fiber Content and Product Components
Sylvie Silk identifies the fiber composition and relevant construction details of its merchandise as accurately as reasonably possible.
Sylvie Silk textile fabrics are represented as 100% silk unless a product description expressly states otherwise.
A finished product may include necessary functional or structural components, such as:
- sewing thread;
- elastic;
- closures;
- fasteners;
- labels;
- internal supports;
- packaging; or
- other disclosed components.
The product page should be reviewed before purchase for the applicable composition and construction information.
Prices and Currency
Unless otherwise stated, prices are displayed in United States dollars.
Prices may change before an order is submitted. A change will not ordinarily affect an order already accepted, except where:
- the customer agrees;
- a clear pricing error occurred;
- the order must be corrected to comply with law; or
- mandatory law permits the adjustment.
Shipping charges, sales tax, customs duties, VAT, import taxes, and other charges may be shown separately.

Placing an Order
To place an order, you must provide accurate and complete information reasonably required to process the transaction.
Before submitting an order, you are responsible for reviewing:
- selected merchandise;
- quantity;
- size or dimensions;
- color;
- fabrication;
- customization choices;
- price;
- delivery address;
- shipping method; and
- estimated taxes or charges shown at checkout.
Submitting an order constitutes an offer to purchase the selected merchandise under these Terms.
Order Acknowledgment and Acceptance
An automated order acknowledgment confirms that Sylvie Silk received the order. It does not necessarily mean that the order has been accepted.
An order may be accepted when Sylvie Silk:
- sends an express order-acceptance notice;
- confirms that the merchandise has entered production where applicable; or
- sends shipping confirmation.
Sylvie Silk may decline or cancel an order before acceptance for a legitimate reason, including:
- unavailable inventory;
- an evident pricing or product-information error;
- inability to authorize payment;
- suspected fraud;
- shipping restrictions;
- sanctions or legal restrictions;
- an incomplete delivery address;
- inability to fulfill a customization request; or
- a website or technical error.
If payment was collected for an order that is not accepted, the applicable amount will be refunded.
Payment Authorization
You represent that you are authorized to use the payment method submitted with an order.
The payment provider may:
- verify account information;
- request authentication;
- place an authorization hold;
- conduct fraud screening; or
- decline the transaction.
An authorization hold is not necessarily a completed charge. The timing of release is controlled by the payment provider or financial institution.
Sylvie Silk does not receive or store every element of payment-card information when payment is processed by an independent payment provider.
Pricing and Processing Errors
When an obvious pricing, quantity, discount, or product-description error occurs, Sylvie Silk may contact the customer for instructions or cancel the affected order before acceptance.
Sylvie Silk will not substitute a materially different product or increase the agreed price without the customer’s authorization where such authorization is required.
New Jersey’s Consumer Fraud Act prohibits deceptive practices, false promises, misrepresentation, and concealment of material facts in connection with the sale or advertisement of merchandise.
Shipping and Delivery
Processing and delivery estimates are provided in good faith but are not guarantees unless expressly identified as guaranteed.
Sylvie Silk will seek to ship merchandise within:
- the time stated on the applicable product or checkout page;
- the time otherwise communicated to the customer; or
- the period required by applicable law.
United States federal rules generally require online sellers to have a reasonable basis for the advertised shipping period or, when no period is stated, the default period prescribed by the rule. When qualifying delays occur, the seller may need to obtain consent to the delay or provide a prompt refund.

Delivery Information and Failed Delivery
Customers must provide a complete, accurate, and deliverable address.
Sylvie Silk is not responsible for a delivery failure caused solely by:
- an incorrect address supplied by the customer;
- refusal to provide information required by the carrier;
- failure to collect a package;
- unauthorized redirection;
- refusal to pay applicable import charges; or
- use of a freight forwarder outside Sylvie Silk’s control,
except where mandatory law provides otherwise.
Additional carrier, customs, storage, reshipping, or return costs may apply as described in the relevant shipping and return policies.
Order Changes and Cancellations
Contact orders@sylviesilk.com promptly to request a change or cancellation.
A request cannot be guaranteed after:
- payment processing has advanced;
- cutting or customization has begun;
- production has commenced;
- the order has been packed; or
- the shipment has been transferred to a carrier.
Mandatory cancellation or withdrawal rights remain unaffected.
Returns, Exchanges, and Refunds
Return eligibility, timing, condition requirements, shipping responsibilities, exclusions, and refund procedures are described in our:

- International Returns; and
- EU Right of Withdrawal pages.
A designation such as customized, personalized, cut to length, hygiene-sensitive, or final sale will not eliminate rights that cannot lawfully be waived, including applicable rights concerning defective, damaged, incorrect, misdescribed, or nonconforming merchandise.
Customized Products and Cut Fabric
Certain merchandise may be:
- made to customer specifications;
- personalized;
- altered;
- produced in a customer-selected combination; or
- cut from a fabric bolt to a requested length.
The product page or checkout process will identify applicable terms before purchase.
Once cutting, alteration, personalization, or production begins, the customer’s ability to modify or voluntarily cancel the order may be limited, subject to mandatory law.
Promotions and Discount Codes
A promotion or discount may be subject to separate conditions, including:
- start and expiration dates;
- eligible products;
- minimum purchase;
- geographic limits;
- customer eligibility;
- quantity limits; and
- restrictions on combining offers.
Unless stated otherwise:
- promotional codes have no cash value;
- only one code may be used per order;
- a code may not be applied retroactively;
- a code may not be transferred or resold; and
- a promotion may be suspended when fraud, misuse, or technical error occurs.
No promotion will be administered in a manner that unlawfully removes mandatory consumer rights.
- Customer Accounts
You are responsible for:
- maintaining accurate account information;
- protecting your password;
- restricting access to your device;
- reviewing activity associated with your account; and
- notifying Sylvie Silk of suspected unauthorized use.
Sylvie Silk may require password changes, additional verification, or temporary account restrictions for security purposes.
Reviews and User-Submitted Content
When the website permits reviews, photographs, comments, or other submissions, you represent that:
- the submission is truthful;
- it reflects your genuine experience;
- you have the right to submit it;
- it does not infringe another person’s rights;
- it does not contain unlawful or malicious material; and
- any material relationship or incentive is disclosed where required.
You retain ownership of your original submission. By submitting it, you grant EVELYN SYLVIE Inc. a nonexclusive, worldwide, royalty-free license to reproduce, display, publish, adapt, translate, and use it in connection with Sylvie Silk’s website, communications, advertising, and business, subject to applicable privacy law.
Sylvie Silk may moderate or remove content that violates these Terms, but will not knowingly manipulate reviews in a manner that misrepresents genuine customer opinion.

Nothing in these Terms deprives a consumer of a mandatory remedy.
Indemnification

- utility or telecommunications failure;
- cyberattack;
- carrier suspension;
- customs action; or
- shortage of necessary materials.
Sylvie Silk will take reasonable steps to communicate material delays and provide remedies required by applicable law.
International Use
The website may be accessed from locations where Sylvie Silk does not currently offer delivery.
Access to the website does not guarantee that:
- products are available in that location;
- delivery is permitted;
- checkout is enabled; or
- a transaction complies with local law.
Customers are responsible for providing accurate destination information and complying with lawful import requirements assigned to them.
European Union Consumers
Sylvie Silk does not currently accept orders for delivery to the European Union.
Before EU sales are enabled, these Terms and the checkout process will be reviewed for applicable EU and national requirements.
EU online consumers must generally receive specified pre-contract information and written confirmation of the transaction, and consumer terms must be presented in plain, understandable language without unfair provisions. Those protections may also apply to a non-EU trader that directs its commercial activity toward EU consumers.
Once EU sales are activated, these Terms will not override:
- the EU right of withdrawal;
- statutory conformity rights;
- mandatory legal guarantees;
- applicable national remedies;
- data-protection rights; or
- jurisdictional protections that cannot lawfully be waived.
Governing Law and Courts
These Terms are governed by the laws of the State of New Jersey and applicable federal law, without regard to rules that would require application of another jurisdiction’s law.
Subject to mandatory consumer-law protections, legal proceedings relating to these Terms may be brought in a state or federal court with jurisdiction in New Jersey.
This provision does not deprive a consumer of:
- mandatory protections of the consumer’s home jurisdiction;
- a legally protected right to bring a claim in another court; or
- a remedy that cannot lawfully be waived.
Severability
If a provision of these Terms is found unlawful or unenforceable, that provision will be interpreted or limited to the minimum extent necessary.
The remaining provisions will continue to apply unless the essential purpose of the agreement would be defeated.
No Waiver
Failure by Sylvie Silk to enforce a provision on one occasion does not waive the right to enforce that provision or another provision later.
A waiver is effective only when clearly given by an authorized representative.
Assignment
You may not transfer contractual rights or obligations arising from an order without Sylvie Silk’s consent, except where applicable law permits otherwise.
EVELYN SYLVIE Inc. may transfer these Terms in connection with a lawful merger, restructuring, sale, or transfer of the Sylvie Silk business, provided that mandatory consumer rights remain protected.
Entire Agreement
These Terms, together with:
- the applicable product description;
- order summary;
- order confirmation;
- incorporated website policies; and
- any written terms specifically agreed for the transaction,
constitute the agreement concerning the applicable website use or purchase.
When documents conflict, a specific written term agreed for the particular transaction ordinarily controls over a general website term, subject to applicable law.
